      Investor apartment status (Holder of Unsold Shares) “can” pass from investor to investor so long as neither have ever occupied the apartment. Therefore, the “original sale” could have been a CAH/Holder of Unsold Shares transaction.

      During the Jain administration I tracked numerous investor to investor sales. Almost like trading baseball cards. There were 10-15 investors doing that. Several of those “traders” remain existing shareholders today and may still be trading though they no longer have the Jain/Cecere collaboration.

      And YES some served on the Board. It was a very tight group operating within the By Laws and original Offering Plan.

        The apartment was not sold under CAH management.

          You only read what you wanted to read. You didn’t give thought to him being a Holder of Unsold Shares where he can rent for eternity.

          Go to ACRIS and enter the Property Number 2086 and Lot number 50 and the apartment number. It will show all transactions for that apt # in all 6 buildings. Then look at each entry until you find the one in your building. If it was bought from Carol Mgmt or CAH there’s nothing you can do about the number of renters. You can try 311 to see if the cigarette smoke is a City violation.

            So I have a neighbor who is living and renting for more than 6 years and smokes on the balcony every day even though I complained to the office and it’s a 311 violation if indeed the smoke gets into the apartment. Office doesn’t do anything about it why because the person who owns the apartment is a real estate attorney himself and Bukharian. Why do these people think they have more rights than anyone else in this country?! Isn’t that shady. My best bet is that attorney pays the management on the side for allowing to rent the apartment for more than 6 years.

                  The 8th was a Friday followed by the weekend and Veterans Day so it took just two days to post the results.

                   

                  The real question to ask is what took Honest Ballot TEN DAYS to process 605 ballots?????????

                    If the shareholder purchased the apartment directly from the original sponsor (being either Carol Mgmt or CAH) and has never lived in the apartment then the apartment can be rented for eternity. Buying from the sponsor gives the same rites as the original sponsor. You’ll find that mentioned several times in the Proprietary Lease as “a buyer of Unsold Shares”.

                     

                    However, if the apartment is a sublet then, I believe, the shareholder of record must sell the apartment after 5 years OR pay a 50% sublet fee over and above their monthly maintenance upon the 5th year.

                     

                    Whether a holder of unsold shares or a subletter they are responsible for the actions of their renter and the renter is subject to the same House Rules as are the resident shareholders.  So when you see a violation – email the management office (so that you have a record of your complaint). The property manager can notify the “owner” and impose a monetary fine for the violations made by their renter.  If the violations and fines pile up the Board can act under the provisions of Objectionable Conduct to revoke the Lease. Read about it on page 21 of your Proprietary Lease.

                      The bottom of the Honest Ballot 2024 election result certification states it was dated November 8th.

                      They were posted the 13th. WHAT TOOK THE BOARD SO LONG TO POST THE RESULTS?

                      Tampering with the numbers maybe? or switching the names from one spreadsheet box to another maybe?

                       

                      Also, Joseph Chau has more professional experience that any of the others (unless you want to count RICO experience)

                        How many years according to the bylaws can a shareholder rent his apartment for until he’s deemed to sell? There’s a shady lawyer who owns a an apartment Here and seems to be getting away with him because he’s a real estate attorney himself? I find that unfair, the the tenants he leases to thinks they can do whatever they want including smoking and f**arting on the balcony all day long

                          <p style=”text-align: left;”>Does anyone here look at the Financials? It’s hard for me to understand as I’m not in tune with understanding finances but it looks like our reserve went from roughly 10 million to 8 million between 2022 and 2023. Am I understanding tgis correctly?</p>

                              The results are posted.  Joseph Chau came in first and one new member was elected.  Look on your ground floor for the results.  Side note:  I bet if a slate that was ½ Asian ran it would win.  Something to think about for next time.
