A “slate of candidates” doesn’t mean that you have to vote for all the candidates.  It means that you have a better chance of electing at least some of the candidates that are not presently on the board.  Individuals can only do so much to get elected while a group of candidates can coordinate in getting a greater number of votes.  Furthermore, the present board members will go around getting proxies as a slate and will then all be reelected while no individual opposition members will have the same strength of numbers.

Why is David ( Navid) driving an SUV that has a Tennessee license plate.? He lives and has lived in New York.

I’ve said this many times before. If you want to run for the Board, you do not want to be part of a slate of candidates.

A slate means you want shareholders to vote for the entire group whether you like some of them them or not.

Remember, a slate is like a chain and a chain is only as strong as its weakest link.

In the last election I voted for individuals based upon their qualifications. There were two candidates on the new candidates slate last year that that I didn’t like so I waited for the official proxy to come in the mail and I voted for just 5 candidates AND I brought my proxy to the meeting and handed it to the election company employee. That way, no one could falsify my vote.  Over 300 proxies were falsified last year.

If you don’t like what has been happening with the current Board then choose the people you feel will be good for the co-op and mark their names on the proxy that you will get in the mail AND GO TO THE MEETING AND HAND IT IN or give it to a neighbor that you trust to hand it in for you.

There are shareholders who say they are not going to vote and then the “cheaters” will fill out a paper proxy and forge their name on it. When a neighbor says they are not going to vote ASK THEM TO PLEASE SIGN AND GIVE YOU THEIR PROXY.

Lastly – date your proxy for the date of the meeting.

I will not run for the Board.

Actually, there is something that can be done.  Get a slate of candidates ready to run before the next election is announced.  Then make sure to go around and collect proxies.  That is the fastest and most effective way.  Otherwise, nothing will change.

It’s too soon to tell if anything will be done on the purchasing conflict of interest.

It supposedly happened in June of 2022 and if the Board and Akam look further – it might just be one drop in a big bucket of water.

Justifiably, the Board should oust the treasurer and Akam should oust the property manager. Let’s wait and see.

Ron Migut,  what do we need to do to organize and bring formal action against the current administration? Can we begin the process of gathering the relevant information and brainstorm a course of action?

Our co-op Treasurer orders 40 cases of toilet paper from Staples to be shipped to “his” Trading Company in Glendale NY.

The Purchase Order for his purchase reads PO# Park City 3/4.

The 40 cases are now in the basement of 9707.

We know he paid approximately $2,400.00 for the shipment from Staples but the real question is

HOW MUCH DID OUR CO-OP TREASURER CHARGE OUR CO-OP FOR THE SHIPMENT?

NOTE: Our co-op could have purchased it directly from Staples so it was not necessary to buy it from a third party (the co-op Treasurer’s trading company)… unless some people decided they could personally profit from the purchase and re-sale… I would guess???

I wonder how many members of the Board of Directors approved this “deal”?

The Board has no idea that they can be personally sued. The lawyer, Emma, should be the one advising them. She can also be held liable. This should be brought up at the meeting in October. Why did they move the meeting?

                          REPERCUSSIONS OF STUPIDITY

David (real name Navid) is employed by Akam.

All maintenance staff are employed by the co-op. The co-op is legally their employer.

David (who is not the employer of those men) recently fired 3 of the co-op’s employees using co-op stationery for their termination letters.

That implies that their “employer” (co-op Board of Directors) consented to those firings and they authorized David to execute the terminations.

Some shareholders are of the opinion that the firing of the 3 Hispanic maintenance men was mostly personal discrimination by David.

The U.S. Equal Employment Opportunity Commission [EEOC] investigates all filed claims of wrongful and prejudicial terminations.

If the EEOC determines these were wrongful terminations they will hold the employer – Park City 3 and 4 Apartments, Inc. – responsible and liable for all assessed damages.

In that event, Akam will not be responsible for  a dime, as David/Akam is/was not the employer of record.

This is what can happen when we have a totally ignorant Board compounded by an inexperienced property manager.

The Board theoretically allowed a bull in the China shop – all at our expense.

(the same would apply to maintenance men making illegal inspections at David’s instruction – should shareholders seek a Class-action against the entire Board of Directors for invasion of their privacy)

Rumor going around that Mr. Jain is done with this co-op and even left the country for awhile. Any truth to this?
